How we collect, use and protect your personal data.

1. Who we are

This website (thebuyersagentportugal.com) is operated by Singlessence Lda. (“The Buyer's Agent Portugal”, “we”, “our” or “us”), a Portuguese limited liability company licensed to provide real estate mediation services under AMI Licence 23932.

For the purpose of the EU General Data Protection Regulation 2016/679 (the “GDPR”) and the Portuguese Data Protection Act (Law 58/2019), Singlessence Lda. is the data controller for the personal data described in this policy.

2. The personal data we collect

We collect personal data in the following ways:

  • When you contact us — via the contact form, an intro call booking, email, WhatsApp or social media: name, email address, phone number, country of residence, a brief description of what you are looking for, and any other information you choose to share.
  • When you download a guide — name and email address, so we can send you the PDF and follow up if you ask us to.
  • When you register a property as a seller — your contact details and the property information you submit.
  • When we engage you as a client — additional information strictly necessary to perform the engagement (identity documents required by anti-money-laundering rules, financial capacity, sometimes tax residency information).
  • When you browse the website — basic technical information such as your IP address, browser type, pages visited and approximate geographical location. See “Cookies and analytics” below.

3. Why we process your data and the legal basis

We process your personal data only for clear, specific purposes:

  • To respond to your enquiry and provide our services — legal basis: performance of a contract or taking steps at your request prior to entering into a contract (Article 6(1)(b) GDPR).
  • To send you a guide or follow up after a download — legal basis: your consent (Article 6(1)(a) GDPR), which you can withdraw at any time.
  • To comply with legal obligations — including AMI regulation, anti-money-laundering checks (Law 83/2017) and tax record-keeping — legal basis: legal obligation (Article 6(1)(c) GDPR).
  • To improve our website and services — legal basis: our legitimate interest in understanding what works and what does not (Article 6(1)(f) GDPR), balanced against your reasonable expectations.

We do not use your data for automated decision-making or profiling that produces legal effects on you.

4. Who we share your data with

We do not sell, rent or trade personal data. We share it only with the parties strictly necessary to deliver the service you asked for, namely:

  • Service providers acting as processors on our behalf: website hosting (Dokploy / Kalin Digital), email infrastructure (Brevo for transactional and marketing emails), calendaring (Brevo Meetings), and customer relationship tooling.
  • Professional advisors you ask us to coordinate with: lawyers, tax advisors, mortgage brokers, currency specialists, surveyors, immigration counsel. We only share what they need to do their job.
  • Competent authorities: where we are required to by law (AMI, tax authority, anti-money-laundering supervisor, courts).

When a processor is located outside the European Economic Area we ensure transfers are covered by Standard Contractual Clauses or an adequacy decision of the European Commission.

5. How long we keep your data

  • Enquiry-only data (you contacted us but we did not engage): up to 24 months, after which we delete or fully anonymise it.
  • Marketing consents (guide downloads, newsletter): until you unsubscribe or three years of inactivity, whichever comes first.
  • Client engagement records: 10 years after the engagement ends, as required by Portuguese AML and accounting rules.
  • Website analytics: aggregated indefinitely; raw events purged after 14 months.

6. Your rights under the GDPR

You have the right to:

  • Access the personal data we hold about you.
  • Have it corrected if it is inaccurate or incomplete.
  • Have it erased, where there is no overriding legal obligation for us to keep it.
  • Restrict or object to its processing.
  • Receive your data in a structured, machine-readable format (portability).
  • Withdraw any consent you previously gave (without affecting the lawfulness of processing carried out before the withdrawal).
  • Lodge a complaint with the Portuguese supervisory authority, Comissão Nacional de Proteção de Dados (CNPD).

7. Cookies and analytics

This website uses a minimal set of cookies. Strictly necessary cookies keep the site running (preferences, form state). If we use analytics, we configure it to IP-anonymise and aggregate data only — no cross-site tracking, no advertising cookies, no third-party retargeting pixels.

You can disable cookies in your browser at any time. The site will continue to work, but some functionality (such as form submission) may behave differently.

8. Security

We protect your data with industry-standard technical and organisational measures: encrypted connections (TLS), encryption at rest where supported by our providers, restricted access on a need-to-know basis, and regular review of who can see what. No system is perfectly secure, but we treat your data as we would expect ours to be treated.

9. Children

Our services are intended for adults. We do not knowingly collect personal data from anyone under the age of 16. If you believe a minor has provided us with data, please contact us and we will delete it.

10. Changes to this policy

We may update this policy from time to time to reflect changes in the law, our services or our practices. The “Last updated” date at the top will always show when the current version came into effect. For material changes we will notify clients we are actively engaged with by email.
